Adherence to federal and state regulations governing the installation, operation, and closure of underground storage tank systems.
UST compliance refers to meeting the federal and state regulatory requirements for underground storage tank systems throughout their operational life. Key compliance areas include proper installation, leak detection monitoring, corrosion protection, spill and overfill prevention, financial responsibility, and operator training.
The 2015 revisions to the federal UST regulations strengthened requirements significantly. UST owners and operators must now conduct periodic testing of equipment, maintain records of inspections and testing, and ensure that all UST system components meet current technical standards. States may impose additional requirements beyond federal minimums.
Non-compliance can result in enforcement actions including fines, required corrective actions, and in severe cases, criminal prosecution. The EPA and state agencies conduct inspections to verify compliance. Property owners considering purchasing sites with USTs should conduct thorough due diligence including Phase I Environmental Site Assessments to identify potential compliance issues.
